Terms of Sale Policy
These terms of this policy govern all furniture purchases made through Set the Stage Boise Treasure Valley (“we,” “us,” “our”) via our online shop (https://btv.wesetthestage.com/shop/) and subsequent webpages. By completing a purchase, the customer (“you”) agrees to the policies outlined below.
1. Definitions of Furnishings
Items are categorized based on their source and usage:
- Manufacturer Direct:
- Purchased from wholesale vendors and shipped to our warehouse in Boise.
- Typically received within 2-3 weeks of order. Available for pickup within 48 hours of receipt or delivery within 14 days of receipt.
- Every item is thoroughly inspected, professionally assembled, and turned over to the consumer in brand new condition.
- If a damaged item is received from the wholesaler, the consumer will be contacted with an updated timeline to discuss options, which may include but are not limited to (1) the wholesaler shipping replacement parts or (2) a full replacement item.
- Overstock:
- Staging inventory that has gone unopened (other than for initial inspection) and unused. They remain in their original packaging, complete with all parts.
- Typically available for pickup within 48 hours of retail order completion or within 14 days for delivery.
- Every item is thoroughly inspected, professionally assembled, and turned over to the consumer in brand new condition.
- If damage is discovered during inspection and assembly, the consumer will be contacted with an updated timeline to discuss their options.
- Staged Inventory:
- Items that have been used for professional home staging, free of home occupants, pets, cigarette smoke, and odors. All staged items are in fully functional condition.
- Upon order completion, all items are inspected, cleaned, and remediated.
- Items will be turned over to the consumer in one of the following conditions:
- Excellent Condition: Like-new, no visible wear or damage.
- Very Good Condition: Some minor signs of wear. No visible damage.
- Good Condition: Some minor signs of wear. Some visible damage,
2. Returns, Refunds, and Warranties
- All items are sold as-is.
- No returns or refunds are accepted.
- No warranty is expressed or implied.
Justification for Terms of Sale: Set the Stage Boise Treasure Valley provides buying options priced significantly below market value by cutting the overhead costs associated with returns, refunds, and facilitating warrantee claims. The buyer accepts that receiving this increased value comes with certain risks.
3. Consumer Responsibilities and Acknowledgment
- Acceptance of Terms: The consumer will be prompted to accept these terms prior to submitting their order online at check out by clicking a checkbox.
- Fulfillment Acknowledgment: Consumers will be asked to sign a fulfillment slip accepting these terms of sale when the item(s) is/are turned over to their custody during pick up or delivery. Since this policy applies to all items, one signature covers all items in a multi-item order.
- Fit and Dimensions: The consumer is solely responsible for ensuring that items will fit into their home/space. Item dimensions are posted on each product details page.
- Product Imagery and Condition Acknowledgment: The consumer acknowledges and agrees that images used for “Staged Inventory” items may be stock images from the original manufacturer and may not reflect the precise current condition (which is detailed in Section 1). The use of such stock imagery is for illustrative and informational purposes only and is not an intent to deceive or misrepresent the item’s current condition. The consumer agrees to rely solely on the explicit condition rating (Excellent, Very Good, or Good) and description provided for the specific item at the time of purchase.
4. Delivery and Pickup Logistics
- Delivery Service: Standard delivery includes placing items inside the home. The standard service does not include moving existing furniture, wall mounting, or complex installation.
An optional White-Glove Delivery service may be purchased at check out. White-Glove service includes placing the purchased furniture in the exact location desired by the homeowner, but it does not include the removal or relocation of the homeowner’s existing furniture. - Liability During Delivery: Delivery is conducted through a partner service provider. Any damage to the consumer’s property during delivery or assembly will be the responsibility of the partner provider. Insurance claims must be filed directly with our partner.
- Missed Deliveries: Missed deliveries will incur an additional delivery charge of no less than $75 per item. Additional delivery times are subject to schedule availability.
- Missed Pick Up: Failure to pick up items within the specified timeframe will incur a storage fee of $
5. Damaged/Defective Goods During Transit/Pickup
- Reporting Damage: The consumer must inspect all items at the moment of pickup or delivery. Any damage must be reported immediately to the delivery or pickup agent and noted on the fulfillment slip before signing.
- Liability Shift: Liability shifts from the company to the consumer immediately upon signing the fulfillment slip, except for any damages specifically noted on the slip. We bear no liability for concealed damages discovered after the fulfillment slip has been signed without exception.
- Manufacturer Direct Replacements: If the updated timeline for a replacement of a damaged “Manufacturer Direct” item is unacceptable, the consumer’s only option is to cancel the order and receive a full refund.
6. Pricing and Payment Terms
- Payment Finality: Online payments are processed via Stripe (accepting most major credit cards) and are considered final and non-refundable upon successful online order completion. Klarna pay-over-time financing is also extended to qualified buyers.
- Deposits: We do not charge a deposit for online orders.
- Pricing Errors: Only a discrepancy between the price published on the product details page and the final price paid (published on the invoice receipt) will be refunded. Advertised and discounted pricing are subject to additional terms defined in promotional content.
7. Limitation of Liability and Legal
- Maximum Liability: We accept no liability for damages related to the purchase. We will not knowingly release a defective product to the consumer, but all risk is assumed by the consumer upon receipt of the item(s).
- Exclusion of Damages: The policy explicitly excludes all liability for consequential or incidental damages (e.g., if a faulty staged item causes damage to the consumer’s floor).
- Governing Law: The laws of the State of Idaho shall govern the interpretation and enforcement of these terms.
- Dispute Resolution: Any legal disputes will be resolved exclusively in the courts of Ada County, Idaho.
- Mandatory Binding Arbitration: All disputes arising out of or relating to these Terms of Sale shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA) and shall be held in Boise, Idaho. The decision of the arbitrator(s) shall be final and binding on both parties.
8. Force Majeure
We shall not be liable for any delay or failure to perform any of our obligations under these Terms of Sale if such delay or failure is caused by an event beyond our reasonable control, including but not limited to, acts of God, war, terrorism, floods, fire, labor disputes, strikes, pandemics, epidemics, transportation shortages, significant material shortages, or governmental acts. We will notify the consumer promptly upon the occurrence of any such event and use reasonable efforts to minimize the impact of such events.
9. Severability
If any provision of these Terms of Sale is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from the remainder of these Terms of Sale, and the remainder of the Terms of Sale shall remain in full force and effect.
10. Waiver
Our failure to enforce any right or provision of these Terms of Sale shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. A waiver in one instance shall not constitute a waiver of any subsequent right or provision.
11. Intellectual Property Rights
All intellectual property rights, including copyrights, trademarks, trade names, and logos, displayed on our website, marketing materials, or associated with our business are and shall remain our exclusive property or the property of our licensors. The consumer’s purchase of goods does not grant any right or license to use any of our intellectual property.
12. Amendments and Notice of Changes
We reserve the right to modify these Terms of Sale at any time. Changes will be effective immediately upon posting the revised Terms of Sale on our website. It is the consumer’s responsibility to review these Terms of Sale prior to each purchase. Any changes will not apply retroactively to orders confirmed before the date of the change.
